Dear NORML Member,

In response to this week's Supreme Court ruling granting the Justice Department the authority to prosecute state-authorized medicinal cannabis patients for violating the federal Controlled Substances Act, members of the US House of Representatives may vote as early as next week on an amendment to bar the US Department of Justice (DOJ) from prosecuting patients who use medical cannabis in compliance with state laws.

This important bi-partisan provision, scheduled to be introduced next week by Reps. Maurice Hinchey (D-NY) and Dana Rohrabacher (R-NY) as an amendment to the 2005 Justice Department appropriations bill, would prohibit the DOJ and the Drug Enforcement Administration (DEA) from spending taxpayers' dollars for the purpose of pursuing "any criminal or civil penalty or remedy against any person for the production, distribution, or use of marijuana for medicinal purposes in a state that authorizes that production, distribution, or use."

Writing for the Court's majority, Supreme Court Justice John Paul Stevens said that he longs for the day when medicinal cannabis advocates "may be heard in the halls of Congress." The 2005 Hinchey/Rohrabacher medical marijuana amendment does just that -- giving Congress the opportunity to go on record to protect and support the health and safety of patients who use cannabis therapeutically in compliance with the laws of their state. A vote on the amendment is expected as early as next Wednesday, so members of Congress urgently need to hear overwhelming support from their constituents. Please call and/or e-mail your member of the US House Representatives today and ask them to vote "yes" in favor of the Hinchey/Rohrabacher medical marijuana amendment. Hello all


In the ruling that was giving by the courts, i see that it is a vaild one. Being that the court merely agreed that the FEDs had the authority to prosecute thoses individuals. Which could be questioned on an issue of states rights. Oherthan that i would love to see a jury of their PEERS convict someone of possesion or what not as it pretains to medical uses. No jury in my eyes will do this. All though it may be appaled i figure but none-the-less the people will have allready spoken by rendering a no conviction. As a side note congress will not act as they need many public oppinion polls before they will do anything. Which is wrong for many reason as i am asuure that you allready know them.

This court case was the questioning of Federal authority and the states lost. No jury would convict based on medicinal use. The problem is that, in Federal court, medical use is not allowed to be heard by the jury.

Ed Rosenthal was providing clones to legal patients with the approval of local government. In court the Federal prosecutor lied and accused Ed of being a drug kingpin and the jury convicted based on that lie. None of the evidence about medical use was heard by the jury.

In the meantime, it will be used by millions of Americans every year anyway. Too bad the government has to punish the weakest in society, the sick and dying, in order to justify prohibition.

As I see it, the issue IS state's rights...and the Fed just said, "States don't have any..." in complete violation of the Bill of Rights, chiefly...

The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people

And where can it be questioned? That's the highest court in the land.

It's now up to the congress.

Would you comment further on your opinion that the decision is valid?

it defently is an issue of state right. I belive thay are using the fed. gov. right to control interstate comerce to prosicute the med. users. how can somthing fall under inter-state trade when it is not even a tradable comodity. Not taxed. Thay would also hafta prove that the canibis originated out side the state, and therefore fell under the inter-state comerce clause.
