ATTORNEY GENERAL JOHN ASHCROFT, D.E.A. HEAD KAREN TANDY AND ED KUBO,
FEDERAL
PROSECUTOR, SUED TO PREVENT RELIGIOUS AND THERAPEUTIC CANNABIS ARRESTS


Aloha. A Complaint for injunctive relief was filed today
in the
U.S. District Court for the District of Hawaii against U.S. Attorney
General
John Ashcroft, D.E.A. Administrator Karen Tandy, and local U.S.
District
Attorney Ed Kubo by religious and medicinal consumers of cannabis.

The suit seeks to enjoin the Federal government from
arresting and
prosecuting those residents of Hawaii whose religions and religious
beliefs
require the consumption of cannabis (the herb governments
derogatorily label
as "marijuana").

The lawsuit also seeks protection from federal prosecution
for
those citizens of Hawaii who cultivate, consume and/or distribute
cannabis
legally pursuant to legislatively enacted Department of Public Safety
Narcotics Enforcement Division guidelines and valid patient/caregiver
registration certificates.

The suit was sparked by the recent arrest of a local Hilo
THC
Ministry Reverend, and the ensuing prosecution for cannabis
cultivation by
the U.S. Department of Justice.

The case has a high probability of success, based upon the
recent
ruling by the Ninth Circuit Court of Appeals (whose decisions serve as
precedent in Hawaii) in Raich v. Ashcroft. Angel Raich and other
Californians and caregivers can now consume and cultivate therapeutic
cannabis absent the often realized fear of federal prosecution for
their use
of a non-toxic and natural herbal medicine.

The Plaintiffs also rely upon the federal Religious Freedom
Restoration Act to secure their definitive right to free exercise of
religion.
That Act was recently used to prevent the federal government from
prosecuting a New Mexico based, Brazilian Uniao Do Vegetal themed
religion
for their importation and distribution of Ayahuasca, a
hallucinogenic-laced
tea from the Brazilian rainforest.

According to Michael A. Glenn, Esq., the Hawaii attorney
for the
churches and patients suing Ashcroft, "The Federal Government
has zero
compelling interest in preventing either the religious or therapeutic
consumption of cannabis by Hawaii's citizens. More people died last
month
from eating peanuts, jaywalking or taking aspirin than have ever been
harmed
by cannabis in the entire history of its use. And, even if you take
the
federal government at face value and accept that they have the power
and
duty to protect one from one's own folly, the mandatory terms of
imprisonment faced by cannabis users have zero relationship to the
goal of
harm reduction and indeed smack of Draconian punishment for
freethinking,
non-violent Reverends and patients leading law abiding lives."

You know I was re reading Rogers kind letter to Ashcroft. That is as powerful a letter as martin Luther Kings "I have a dream" speech that is totaly DIVINE. Here it is again theres been alot of newcomers lately. Instead of accepting healing love and wisdom Ashcroft ran to do injustice to one of our Reverends. Oh John John when will you learn? Its not good to return good with evil. Almighty God does indeed watch over his flock. David slue Goliath.

Dear John Ashcroft,

Aloha. I just heard today that you were suddenly taken ill and have been in intensive care with pancreatitis and gallstones.

Some of the news said that you were likely in pain and could possibly die. I want you to know that it's my hope and my prayer that you have a safe and painless and quick recovery, and that you live a long and happy life.

As I say to everyone who will listen, if you haven't done so already I recommend that you re-frame your experience from bad to good, bless it, have faith and I know that it will shower you with positivity.

The phrase I like best is, "God, that's great! Please show me the blessings in here...and hurry!" I use this phrase every day in my own life and also in counseling with others. (Come to think of it, I use it to counsel people who have been harmed by social policies that you maintain and even inflame. What's up with that?) I offer it as a gift of love and compassion from me to you.

My favorite book for diagnosing and treating illness and other troubles is YOU CAN HEAL YOUR LIFE by Louise L. Hay. I want to recommend it to you for a few reasons. One; for your own personal recovery, and two; to help you discover how to better heal our troubled world-at-large.

Here's what the author says about gallstones: they are likely caused by bitterness, hard thoughts, condeming and pride.

Here's the affirmation the author recommends you repeat to immediately go into recovery and healing - from within. "There is joyous release of the past. Life is sweet and so am I."

Here's what the author says about pancreatitis: it's probably caused by rejection, anger and frustration because life seems to have lost its sweetness.

Here's what the author recommends as an affirmation to go into instant recovery: "I love and approve of myself, and I alone create sweetness and joy in my life."

John, there have been (many) times over the years when I was tempted to see you as my enemy, literally as an evil person bent on destroying most of what I, and others, hold dear.

My tough feelings for you remind me of a book I read that gave me some valuable wisdom, THE ART OF WAR. One of the best ideas I ever read came from there. The author said that it was accepted in his day that a superior warrior could cut-off his opponent's head in battle. The exceptional warrior, however, would change his opponent's heart.

I want to stop and offer myself as a good Samaritan to you, John. We have been on such the opposite sides of many important issues, especially the war on drugs, privacy and civil liberties. The frail Pentecostal patriarch -- whose journey included studies at New York University and the presidency of a liberal arts college in the Ozarks -- began swinging his arms, trying to get up. Ashcroft later wrote that he urged his father to stay seated.

"John," he replied, "I'm not struggling to stand, I'm struggling to kneel."

Evoking another biblical symbol, the father anointed his son's forehead with oil. In place of the traditional olive oil, someone provided vegetable oil.

The father gave his son a final blessing and then died the next day.

Media gossips offered a twisted take on this scene last week. Here's the Washington Post's spin on one of the holiest moments in the senator's life.

"Clinton White House wags have dubbed controversial attorney general nominee John Ashcroft 'The Crisco Kid'," said the "Reliable Sources" column. "We phoned the folks at Proctor & Gamble ... to ask their reaction to Ashcroft's unorthodox use of the product." A spokesperson said, "Crisco is a great moisturizer for dry skin, and people have used it as a lubricant. ... (We) prefer that people cook with it."

Cue the laugh track. Obviously, Ashcroft's supporters have not been amused as his faith has been dissected and ridiculed in the public square. But they should not have been surprised, said theologian Gabriel Fackre, of the liberal United Church of Christ.

Cruel things happen when the poetry of faith gets jammed into political headlines. Some of Ashcroft's enemies would rather talk about holy oil, speaking in tongues and Bob Jones than about his work in the U.S. Senate, the National Governors' Association, the National Association of Attorneys General or at Yale and the University of Chicago.

"Ashcroft's critics didn't like it when he told people at Bob Jones University that here in America we can say, 'We have no king but Jesus,' " said Fackre. "Of course, when he said that, he was echoing the words of the early Christians who declared that 'Jesus is Lord' and refused to say that 'Caesar is Lord.'

"So far, so good. But the problem is that when someone like John Ashcroft says that, he also feeds ammunition to all his critics who say that he wants to wed that Christian confession to his own political agenda."

Truth is, two different conversations need to take place about legal and religious issues in public life. The first is rooted in the public's right to expect officials to follow what Fackre called "universally discernible norms" of law and moral conduct. It's one thing to say the president is sinning. It's something else to say he is lying, stealing or cheating.

But Christians may "conduct a second conversation with a president who professes to be a believer," said Fackre, writing in Christianity Today. "This conversation draws upon biblical teachings to which both parties give allegiance, such as matters of repentance and forgiveness, the grace of God, Christian vocation and its responsibilities, the temptations that come with power, and the like."

Americans may be confused about all this, since these "two conversations" overlapped so often during the Clinton era that they created a bitter cacophony.

Some conservatives unintentionally aided Clinton by acting as if he could be impeached for bad theology. Clinton's team then accused his critics of neopuritanism, noted Fackre, even if their calls for his resignation were clearly part of a doctrinal debate between an evangelical president and other born-again believers. And through it all, Clinton used emotional religious language to respond to waves of legal accusations, skillfully suggesting that repentance and pastoral counseling equaled public accountability and justice.

It was a mess. Now, the war of words over Ashcroft is blurring these lines again.
